Exemption: Content Produced by Third Parties

For the purposes of 18 U.S.C. § 2257, the owners and operators are not the primary or secondary "producers" of any content featuring explicit sexual acts, real or simulated, posted on the website. The operator of grannytubes.com limits their activities with regard to sexually explicit content supplied by third-party users to transmission, storage, retrieval, hosting, or formatting only. All content that is furnished by third-party users is posted on areas of grannytubes.com which are under the control of third-party users. Owing to this, the operators and owners of the website are exempt from compliance with Section 2257 records keeping and labeling obligations as set down in 28 C.F.R. §75.1(c)(4). In accordance with 18 U.S.C. § 2257(h)(2)(B)(v) and 47 U.S.C. § 230(c), the operator of the website may delete any contents if such are determined, at the operator’s sole discretion, to be indecent, obscene, defamatory, or inconsistent with the polices and terms of use of the website.
